These Terms of Service (“Terms”) govern your use of Sendnova, the email marketing service provided by Sendnova, Inc. through sendnova.io. By creating an account or using the service, you agree to these Terms.
Your account
You must provide accurate information when you sign up and keep your login credentials secure. You are responsible for all activity that happens under your account. You must be able to form a binding contract to use Sendnova, and you may not use it if you are barred from doing so under applicable law.
Acceptable use
Sendnova is for sending email to people who have agreed to hear from you. You agree not to:
- Send unsolicited email or import lists you do not have permission to contact.
- Send content that is unlawful, deceptive, or infringes someone else’s rights.
- Attempt to disrupt the service, bypass sending limits, or misuse the agents.
We may suspend accounts that put deliverability, other customers, or recipients at risk.
Your content
You keep all rights to the brand assets, copy, and subscriber lists you bring to Sendnova. You grant us the limited permission needed to store that content and to design and send campaigns on your behalf. You are responsible for the content of your campaigns and for complying with the laws that apply to your sending.
Plans and payment
Paid plans are billed in advance on a monthly or yearly cycle. Fees are non-refundable except where required by law. Upgrades take effect immediately and prorate; downgrades take effect at your next billing date. We may change our prices with advance notice, and continued use after a change means you accept the new price.
Cancellation
You can cancel at any time from your account, and your subscription will remain active through the end of the current billing period. You may export your emails and audience when you leave. We may suspend or terminate access for a serious or repeated breach of these Terms.
Service availability
We work hard to keep Sendnova reliable, but the service is provided “as is” without warranties of any kind. To the extent permitted by law, Sendnova is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.
Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will let you know, and the “last updated” date above will reflect it. Continued use of the service after a change means you accept the updated Terms.
